What is Overtime Pay?

Overtime pay is the extra wages earned by eligible employees when they work beyond a set number of hours in a workweek. In the United States, these overtime requirements are mainly regulated by the Fair Labor Standards Act (FLSA).

Under federal law:

  • Non-exempt employees must be paid overtime.
  • Overtime applies after 40 hours in a workweek.
  • Overtime pay must be at least 1.5 times the regular hourly rate (often called time and a half).

How Overtime is Calculated

Let's break it down into simple steps.

Step 1: Determine total hours worked in a week

Overtime is calculated on a per-workweek basis (not per pay period, unless your pay period is weekly).

  • Monday to Sunday workweek
  • Total hours worked: 52 hours

Step 2: Subtract 40 hours

  • 40 hours = Regular time
  • 52 - 40 = 12 overtime hours

Step 3: Multiply the regular rate by 1.5

  • If hourly rate = $14
  • Overtime rate = $14 × 1.5 = $21

Step 4: Calculate total pay

  • Regular pay: 40 × $14 = $560
  • Overtime pay: 12 × $21 = $252
  • Total weekly pay: $560 + $252 = $812
