What is Overtime Pay?

Under federal law:
- Non-exempt employees must be paid overtime.
- Overtime applies after 40 hours in a workweek.
- Overtime pay must be at least 1.5 times the regular hourly rate (often called time and a half).
How Overtime is Calculated
Let's break it down into simple steps.
Step 1: Determine total hours worked in a week
Overtime is calculated on a per-workweek basis (not per pay period, unless your pay period is weekly).
- Monday to Sunday workweek
- Total hours worked: 52 hours
Step 2: Subtract 40 hours
- 40 hours = Regular time
- 52 - 40 = 12 overtime hours
Step 3: Multiply the regular rate by 1.5
- If hourly rate = $14
- Overtime rate = $14 × 1.5 = $21
Step 4: Calculate total pay
- Regular pay: 40 × $14 = $560
